These Terms of Service ("Terms") govern your access to and use of kingofthermos.com (the "Site") and the purchase of Kimos products from Thermo Hot Ltd. ("we", "us", "our"). By using the Site or placing a reservation or order, you agree to these Terms.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering into a binding contract in order to place a reservation or purchase a product from us.

3. Product Description

  • Kimos is a portable, battery-powered bottle that boils water to 100°C in approximately 4 minutes. Product specifications, colors and features shown on the Site are indicative and may be subject to minor changes during production.

4. Pricing Tiers and Reservation

We offer three pricing options for Kimos.
  • The Standard price is $190, which is the full retail price available after the pre-sale period.
  • The Early Bird price is $170. You can join the email waiting list to receive a private purchase link at this price before the public launch. No payment is required to join.
  • The Deposit option allows you to secure the price of $150 by paying a $5 refundable deposit and reserving a unit from the first production batch.

4.1. The $5 Deposit

  • The $5 deposit is charged immediately via Stripe at the moment you complete the reservation.
  • This amount is applied toward your final purchase price. When your unit is ready to ship, we will charge the remaining $145.
  • The deposit is fully refundable at any time before the final payment is charged, upon written request sent to our support email.
  • Once the final payment has been charged and the product has shipped, the Returns Policy described in Section 9 will apply.

5. Orders and Acceptance

  • Your reservation or order constitutes an offer to purchase. A binding contract is formed only when we send you a confirmation email.
  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors or product unavailability. In such cases, any amounts paid will be refunded.

6. Payment

  • All payments are processed by Stripe. We do not store your full payment card details.
  • All prices are listed in US dollars (USD) and do not include applicable sales tax, VAT, customs duties or import charges, which remain your responsibility.

7. Shipping

  • Estimated shipping windows are provided in your confirmation email and are indicative only, not guaranteed.
  • Risk of loss transfers to you once the product is handed over to the carrier.
  • You are responsible for providing an accurate shipping address. We are not liable for delays or delivery issues caused by incorrect information.

8. Cancellation of Reservations

  • You may cancel your reservation at any time before the final payment of $145 is charged.
  • Please note that the $5 deposit is non-refundable, as it secures your place in the production queue and covers administrative and processing costs.
  • To request cancellation, please contact us by email.

9. Returns and Refunds

  • You may request a return within 14 days of receiving the product, provided it is unused and in its original packaging.
  • Return shipping costs are the responsibility of the customer, unless the product is defective or incorrect.
  • Refunds will be issued to the original payment method within 14 business days after the returned product is received and inspected.

10. Warranty

  • Kimos is covered by a 12-month limited warranty against manufacturing defects from the date of delivery.
  • This warranty does not cover damage resulting from misuse, accidents, unauthorized modifications or normal wear and tear.

11. Intellectual Property

  • All content on the Site, including text, images, videos, logos, designs and the Kimos name, is owned by or licensed to Thermo Hot Ltd.
  • You may not copy, reproduce, distribute or create derivative works without prior written consent.
  • The Kimos product is protected by submitted patents.

12. User Conduct

  • You agree not to use the Site in any way that is unlawful, fraudulent, harmful or that interferes with the operation of the Site, other users or our systems.

13. Limitation of Liability

  • To the maximum extent permitted by law, our total liability for any claim related to the Site, these Terms or our products is limited to the amount you paid for the product in question.
  • We are not liable for indirect, incidental, consequential or punitive damages.

14. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the State of Israel.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel, without prejudice to any mandatory consumer protection rights applicable in your country of residence.

15. Changes to These Terms

  • We may update these Terms from time to time. The updated version will be published on this page with a revised "Last updated" date.
  • Where appropriate, material changes will be communicated via email.
